Gender sensitivity has been an important issue in gender-related trials since the Supreme Court’s gender sensitivity ruling in 2018. In recognition of the specificity of the situation, crimes have been recognised on the basis of the victim’s allegations, even in the absence of hard evidence. This is why it is important to scrutinise the credibility of accusers’ statements more closely. This is to recognise differences and achieve true equality.
The Supreme Court’s 4 January judgement in the case of the indecent assault of an autistic man provided a meaningful ruling on gender sensitivity. ‘Consideration of gender sensitivity does not mean that the testimony of a victim of a sexual offence must be recognized unrestricted weight or that accordingly, the prosecution must be decided guilty of the offence, ’the court ruled, indicating that gender sensitivity must be considered alongside the principle of the presumption of innocence.
The credibility of the accusers’ statements was also an important issue in the trial of Pastor Jung Myung-seok of the Christian Gospel Mission (JMS). Accordingly, Jung’s defence lawyers demonstrated that there were many contradictions in the places and times where the complainants refuted to have been sexually assaulted.
For example, complainant M stated that Jung removed the car armrest and sat next to her. However, the objective evidence presented to the court showed that the vehicle they were travelling in was equipped with a fixed armrest, which did not allow a person to sit in the middle.
Furthermore, when a witness who was also a passenger in the vehicle stated that he kept looking at Pastor Jung in the rear-view mirror and did not see that happened, Ms M’s statement was not credible as she was cross-examined further to the effect that the witness could not see in the rear-view mirror because Pastor Jung was sitting in the middle and blocking his view.
‘In this case, objective evidence proved that the complainants ‘statements were not credible, but the appeals court ignored them and ruled on the basis of gender sensitivity, ’said a member of the Christian Gospel Mission.
Article 307 of the Code of Criminal Procedure states that ‘the admission of a criminal offence must be proved beyond reasonable doubt. ’This means that only that which is beyond reasonable doubt should be accepted as evidence.
However, gender sensitivity should be approached more closely because it can lead to violations beyond the principles of presumption of innocence and evidentiary justice. In light of this, experts agree that the trial of Pastor Jung is controversial because it did not observe the principle of presumption of innocence and evidentiary justice based on gender sensitivity.(Continued on page 3)

Pastor Jung Myung-Seok Appeals court rejects admissibility of
‘recording ’as sole evidence
The only evidence in Jung’s trial was a 97-minute recording submitted by a complainant from Hong Kong, Ms M. Some of the recordings were released on JTBC in 2022 and on Netflix’s ‘I Am God’ in 2023, which hit finishing blow the negative publicity against Jung.
Jung’s defence lawyers have argued that Ms M, who usually have mission to records Jung’s sermons and daily conversations, with the help of anti-JMS activists, manipulated and edited Jung’s audio recordings to create tainted evidence that was remind of sexual abuse situations.
The trial court refused to allow the recordings to be examined, but allowed them on appeal court, leading to strong protests from M and anti-JMS activist K and pressure on the court. This was interpreted by some to mean that they were concerned that the manipulation of the recordings would reveal that they had filed a planning complaint.
After a fierce dispute over the authenticity of the recording, the Appeals Chamber refused to admit the recording as evidence in the sentencing on 2 October. Considering that Ms. M had disposed of the mobile phone containing the original recording, making it impossible to compare it with the original, and that the time information in the file structure could be modified and the bitrate value
could be retained even after editing the voice file, the Appeals Chamber judged that the sameness with original file of the recording and integrity submitted as evidence could not be considered to be proven.
The Appeals Chamber did not recognize that the recordings had been manipulated or edited. It also found it difficult to conclude that the complainant had intentionally disposed of the mobile phone used for the recordings with the aim of concealing the manipulation and editing of the recordings.

When Pastor Jung’s lawyers had copies of the recordings examined by experts such as the Sound Identification Institute in Korea and the USA Forensic Institute in the United States, they found 50
places where a third party’s voice was heard. The main suspect sections, such as ‘Yes, here, kk’,
‘Quiet, quiet, quiet, strange’, ‘Okay’, and ‘Yes’, were demonstrated to the court during the trial.
In particular, Professor Bae Myung-jin of the Sound Identification Research Institute testified at the sixth trial court that, during the course of four rounds of examination with five sound analysis experts, the overall recordings were edited and manipulated: ▲ the ‘mouse click ’at the beginning and end of the recordings, which could not have occurred during the recording of the mobile phone ▲ the sound of water spraying and the sound of the water pump power breaker at a nearby watering hole 50 metres away from the alleged damage site which the complaint clamed and ▲ the sound of the mobile phone vibrating during the recording, even though the iPhone does not record vibrations during the recording.
Nevertheless, the Appeals Chamber ruled that the fact of manipulation and editing of the recordings could not be considered to have been proven, as it was questionable whether Professor Bae’s method of analysis was widely recognised in academia and practice. This has led to criticism that the theoretical basis was not clearly presented to the tribunal’s satisfaction.
During the sixth hearing the examination of a witness , the Trial Chamber asked the prosecution witness for his opinion on Professor Bae’s method of analysing the recordings, but the witness did not deny Bae’s method, saying, ‘I don’t know, it’s not our method’. This is explained by the fact that the witness and Bae’s team had different majors and different methods of analysing the recordings.
Appeals Tribunal Takes Evidence as ‘Important material ’
Ex-missionary L’s revelations were not taken into account in the verdict at all
In the run-up to the final hearing of Pastor Jung’s appeal, a former missionary church member, Mr L, sent a certification of contents to the MBC, PD Jo, the tribunal, and Jung’s lawyers on 16 August and 3 September on two separate occasions. The documents were accepted as evidence by the Appeals Tribunal at the concluding hearing in September, saying that they were ‘likely to be important ’and were expected to be crucial in overturning the judgement against Pastor Jung.
The documents included KakaoTalk conversations between Mr. L, the Hong Kong national complainant, and anti-JMS activist Mr K, in which the complainants admitted that they had made prior arrangements with anti-JMS activists and an established denomination’s pastors with the purpose of money, and that they had deliberately recorded their conversations with Pastor Jung, but admitted that the recordings were not suitable as evidence of sexual assault.
It was also found that anti-JMS activist K, who had been speculated to be the mastermind behind the case, led the planning complaint by gathering the alleged victims and offering to pay for their
lawyers. The complainant, M, also revealed that she left the mission because she wanted to get a boyfriend, not because she thought the mission was strange.
However, the final appellate judgement made no mention of Mr L’s evidence, and it was found to have no impact on the outcome of Pastor Jung’s trial. The missionary church members complained of injustice, saying that the trial court did not give the evidence sufficient consideration, even though it contained evidence that they’re trying to frame Pastor Jung for money and that the recordings were edited and manipulated.
Tribunal recognises unproven ‘psychological irresistibility by doctrine’
A distinctive feature of the trial of Pastor Jung Myung-seok is that the prosecution argued that the complainants were ‘incapable of resistance due to missionary doctrine’. Even in the absence of assault and intimidation, the complainants were subjected to sexual victimisation due to their absolute submission to the authority of their religious leaders and their psychological inability to lose logical judgements and this argument was applied commonly in the additional indictments.
However, the prosecution’s main facts charge was based on a distorted interpretation of the mission’s main doctrines from the perspective of established Christian denominations and anti- JMS activists, which differed significantly from the actual mission’s doctrines. Jung’s defence argued that the prosecution’s indictment was a ‘false indictment ’that failed to prove the facts of the charge because it claimed to have indoctrinated the complainants with non-existent doctrines.
The prosecution’s case is that Pastor Jung made his church members believe that he was the Messiah, the Second Coming, or someone above Jesus, and that he made them submit to his absolute authority by threatening them with getting cancer or going to hell if they didn’t listen to him.
According to Jung’s defence lawyers, there are significant differences between traditional Christian doctrine and Jung’s interpretation of the concept of ‘messiah’.
Traditional Christian doctrine interprets a messiah as a divine being with strong religious authority or absolute dominion, stating that ‘a messiah is the same as an absolute deity, and Jesus is the only messiah. ’Pastor Jung, on the other hand, defines a messiah as ‘a human being, not a deity, who plays a role in evangelising people to hear and practice God’s word.’
Furthermore, the defence argued that the concept of the ‘Second Coming Jesus ’in the Mission’s doctrine is the return of Jesus in spirit and does not equate Jung with Jesus. Rather, videos of Jung’s sermons submitted into evidence show him calling himself ‘Jesus ’errand boy’, “I am a line boss”, “Jesus is the tree, we are the branches”, and other sermons in which he humbles himself and emphasises a life centred on only Jesus and God.
In another video submitted as evidence, Jung is heard preaching to his congregation that the church members should respect free will and make their own decisions, saying, ‘You shouldn’t interfere, you shouldn’t over-manage, ’and ‘God doesn’t tell you to do this or that. ’This is incompatible with the concept of irresistibility. The complainants themselves have documented on social media that they travelled freely in and out of the country and abroad during the period of their appeal of damage, as well as their work and leisure activities. This evidence indicates that there was no surveillance and control within the mission that could have caused psychological irresistibility.
In addition to this, the prosecution alleged that the Mission educated the complainant to accept sexual contact with Pastor Jung Myung-seok through the Bridegroom-Bride doctrine. However, the Bridegroom-Bride doctrine in the Mission’s doctrine is a spiritual love that follows and practices the Word and is not physical love. The bridegroom is God, the subject of spiritual love, and the bride is the object of God’s love, all men, women, and children around the world, including Jung himself.
The complainant also acknowledged during her testimony that the bridegroom doctrine is a figurative concept and not a physical relationship, and another complainant wrote a post on an anti-JMS online community after leaving the mission, which she later deleted, indicating that the mission does not have a doctrine that enjoins physical love.
However, on 2 October, the appeals court upheld the prosecution’s main case, as did the trial court.
The complainants’ diaries and notes, submitted by Jung’s defence, showed that they were free to act contrary to the doctrine even after joining the mission, and Jung’s defence cited this as decisive evidence to expose the contradictions in the prosecution’s case. However, the appeals tribunal interpreted that the complainants’ fear of not being saved due to their failure to properly observe the doctrine and their desire for religious salvation made them irresistible to Pastor Jung.
In the end, neither the trial court nor the appellate court wasn’t able to escape the negative public opinion that has been prevalent in society about the mission and Pastor Jung since the Netflix series “I Am God” aired. As a result, it seems that a typical ‘public opinion trial’ and ‘religious trial’ were conducted, rather than a fair trial based on the principle of presumption of innocence and evidentialism.

JMS members take to the streets… What’s their cry?
Held ‘National Prayer Rally for National and World Peace ’in October last year Appealed to ‘Correct the distorted truth about missionary doctrine’
After the broadcast of ‘I Am God ’in March last year, the members of the Christian Gospel Mission spontaneously took to the streets to complain about the image of the mission and the fact that Pastor Jung Myung-seok had been subjected to a court of public opinion rather than a fair trial, as more than 10,000 unverified reports were published in the media and broadcast.
Beginning with a rally at the Boshin-Gak in Seoul in July last year, members of the Mission Church continued to hold rallies in urban centres across the country to express their injustice and call for a fair trial.
In particular, on 15 October, more than 200,000 people gathered in Yeouido, Seoul, to complain about the injustice of Pastor Jung and call for a fair trial, and at the same time, they held the ‘National Prayer for National and World Peace ’to pray for national and world peace, leaving a deep impression on the onlookers with their fervent prayers and charitable praise.
After the National Prayer Rally, the church members were praised for being a model of rallying because of their cleanliness and orderly dispersal, leaving the area free of litter.
This year, the church members have continued to make their voices heard through busking rather than rallies. ‘We are here to correct what has been distorted on TV about the doctrine of the mission and to tell the truth, ’said One church member who has been busking consistently.
‘At first, many people cursed us when they saw us, but more and more people are listening to our voices and cheering us on, ’he said. ’The world sends us cold gazes, but the distorted truth is harder than the gaze. I would like to correct the distorted truth. ’
One church member who is busking in Myeong-dong, Seoul, said, ‘We are taking advantage of the characteristic of Myeong-dong, where there are many foreigners, to give testimonies and preach in foreign languages. We have been speaking in English, French, and Japanese, but we are planning to do it in other languages. Earlier this year, we distributed hot packs, and we are preparing for this winter as well, ’he said, introducing his activities.
These missionaries don’t just preach the Word while busking. They also use their talents to do a variety of other activities. Some churches hold singing concerts, while others donate their talents to make keyrings.

Christian Gospel Missionary Council sues ‘Netflix HQ ’for defamation
Members of the Christian Gospel Mission have filed a defamation lawsuit against Netflix US headquarters in a district court of competent jurisdiction. The Rev. Dong-Won Kwak of the church council said the following‘Even while the investigation into Pastor Jung Myung-seok was ongoing, the programme was broadcast, portraying the mission as a corrupt and fanatical group. In the end, Pastor Jung became the victim of a witch trial by public opinion and was sentenced to a severe prison term.’ ’We will hold Netflix accountable for creating negative public opinion by sensationalising and airing only the one-sided claims of anti-JMS activists and complainants. ’
On 19 August, the Sunday Times reported that the Church Council had lost its lawsuit against Netflix. This is a clear misinformation and fake news, as the case is still in court, according to the Mission’s Church Council.
The church appealed to the Press Arbitration Committee, which was accepted, and on 29 October, the Sunday Times published a report on its website acknowledging that it was a mistake to report the outcome of the Netflix trial.
<‘I Am God ’producer PD Jo sent to prosecution for violating ‘Special Act on Sexual Violence’>
The Netflix documentary ‘I Am God’ was controversial for its sensationalism shortly after its release. It was because of showing overly graphic and provocative footage unfiltered. The mission accused the producer, PD Jo, of violating Article 14, Paragraph 23 of the Sexual Violence Punishment Act of Special Act on Sexual Violence.
The footage he broadcast was either filmed against Pastor Jung’s will or intentionally reenacted. The mission has consistently maintained that the footage was not related to Pastor Jung.
In response, the PD Jo stated at a press conference that they ‘did not intentionally do the mosaic for the purpose of public interest. ’However, after being sent to the prosecutor’s office, he reversed himself in a statement, saying, ‘We broadcast the video for public interest, and it was mosaicked at a high level. ’
There is another problem with the footage in the broadcast. There is another problem with the footage in the broadcast: the reenactment was filmed and aired without any instructions. He’s created a situation, but the lack of explanation led to the misconception that the re-enactors were former church members. The constant showing of the re-enactor’s legs and other parts of her body, more than necessary, led to accusations of objectifying the woman and sensationalising the situation.
The Code of Practice for Reporting on Sexual Violence recommends that reporting on sexual harassment and sexual assault should avoid describing in detail how the assault was committed. This is because it could lead to the victim being defined as an object of sexual activity. However, ‘I Am God’ did not take this aspect into consideration at all, leaving the film open to secondary victimisation.
‘Although PD Jo continues to claim that the footage was used for public interest and not mosaicked for authenticity, the women in the video have suffered harm and their human rights have been grossly violated, including the inability to lead normal social lives, ’the experts criticized.
‘In fact, the videos that have been edited to make them more lewd have been circulating online, perpetuating secondary victimisation. Even if it is for public interest, the consent of the women in the video was not obtained, and the video is more lewd than necessary, so it is not easy to recognise the reason for the ijustifications.’
The Mission Now…Church members pray with unwavering faith and stay true to
basic beliefs
Anti-JMS activists estimated that more than 30 percent of the congregation would leave if Pastro Jung was given a heavy sentence. The PD, which produced ‘I Am God, ’claimed that more than half of its members had left.
However, even after the appeals court ruling, members of the church have remained undeterred. Various events are still being held at the JMS’s Wolmyeongdong Nature Temple. The Stone Tree Festival in October drew large crowds, as did a healing concert in early November and the World Volleyball Championship basketball tournament. Missonary officials said there will continue to be events in Wolmyeongdong after November.
The mission is currently in the midst of a 40-day prayer of repentance. In his closing statement at the appeal hearing, Pastor Jung Myung-seok said, ‘I did to everything they wanted, but I couldn’t do the issue of love. Even now, I am praying for the accusers, ’he said. Rather than blaming the anti-JMS activists, church members are also reflecting on their own spirituality and striving to restore their spirituality through deep prayer and to be faithful to their basic beliefs.

Pastor Myung-Seok Jung, founder of the Christian Gospel Mission (JMS). Pastor Jung Myung-seok’s case making Korea buzz , what is the truth?
Pastor Jung Myung-seok was detained in October 2022 on charges of sexual assault and has been on trial for more than two years now, first at trial and then on appeal. However, in the course of the appeals trial, which began in March this year, a number of compelling pieces of evidence were presented to the court to prove Jung’s innocence
and it seemed to be revealing the shocking truth of a case that had been shrouded in lies and a vast conspiracy.
In the meantime, Pastor Jung has been fighting a David and Goliath battle against the uncomfortable truths and prejudices surrounding him.Falsely accused of betrayal by No.2 and a conspiracy by former church members who abandoned the mission, Pastor Jung was fortunate that evidence poured in to reveal his truth during the appeals process. Nevertheless, on 2 October, the Appeals Tribunal handed down a severe sentence. Crucially, a former church member, L, had sent the Appeals Tribunal several times exposing the accusers and K’s involvement in the scheme, which was accepted as evidence, but due to time constraints, the Appeals Tribunal did not give it a full hearing. The truth will come out, and it appears that Pastor Jung’s truth will be recorded in history forever.
Pastor Jung has now appealed to the Supreme Court, and it will be interesting to see
what the Supreme Court decides.

His comrade in arms’ testimony for Pastor Jung of praying to God for life on the battlefield
Pastor Jung is also a national hero who served twice in the Vietnam War. He testifies that he was in more than 60 situations where he was sure to die, but with God’s help, he came back alive. His comrades-in-arms who fought in the Vietnam War testify that he prayed to God for his life during the war and always read the Bible.
General Chae Myung-Shin, the commander of the South Korean army, wrote in pastor Jung’s endorsement of the book ‘War was Cruelty, Love and Peace’, a testimony of God’s miracles in the Vietnam War, that he movedly described how Pastor Jung witnessed and experienced God’s salvation. ‘Stone Tree Festival’, the world’s only natural temple in Wolmyeongdong, expects to revitalise local economy with differentiated content
Flower festivals in spring, retreats in summer, stone tree festivals in autumn, and Christmas events in winter, all year round held.
The magnificent opening ceremony of the Stone Tree Festival was held on 12 October at the Wolmyeongdong Natural Temple, hosted by the Christian Gospel Mission.
At the opening ceremony of the Stone Tree Festival, a missionary official introduced, ‘Wolmyeong-dong is a natural temple that can accommodate up to 70,000 people, and because it was conceived with stone, it is unique in the world, and it will not decay over time, but rather, because it uses both wood and stone, it was conceived by God to shine more brightly after a thousand years. ’
The Stone Tree Festival is the only festival in the world to be held with the theme of stone and wood. Stone-related festivals have been held in Iksan and Hongseong before, but the Stone Tree Festival in Wolmyeong-dong is the only one that focuses on the magnificent natural stones and trees.
The festival, which began in 2011 as the Stone Jewellery Festival and is now in its 14th year, was held from October 12 to 27 with a diverse programme. After a brief hiatus due to the corona
pandemic, the festival resumed, attracting not only local residents and church members, but also tourists from all over the world to see the world’s only natural holy temple.

In Wolmyeong-dong, more than 100 works with various shapes are displayed in harmony with nature. The natural stones on display at the Stone Tree Festival attracted attention because they were displayed in their natural shape without artificial manipulation.
In particular, the camel rock was excavated by Pastor Jung Myung-seok and his church members for five years, removing soil and unearthing over 1500 tonnes of rock, the shape of a camel. In particular, part of the shape is exposed while buried in the ground, and the neck is hollow, making a sound similar to that of a bell when tapped, arousing the admiration of visitors.
In addition, the stones in Wolmyeong-dong have their own stories and shapes. When visitors hear the stories, they gain a deeper understanding of the value of the artworks and understand why Pastor Jung Myung-seok boasts that they are precious stones jewelry.
Wolmyeongdong is also home to attracting 4 to 500 millennium pine trees, each with its own
shape and story.
The Wolmyeongdong Natural Temple has been developed since 1989, when Pastor Jung received God’s idea to ‘build a beautiful and magnificent millennial temple of God’.
